WEBSITE AND VISITOR REGISTRATION TERMS OF USE

1. DEFINITIONS
The terms used in these Terms shall have the following meanings.
“Website”, the website and related digital interfaces made available through the domain name www.texhibitionist.com and its subdomains.
“Organizer”, İTKİB Fuarcılık A.Ş.
“Fair”, Texhibition Istanbul Fabric, Yarn and Textile Accessories Fair.
“Exhibitor”, a natural or legal person that has been allocated a stand at the Fair venue and has entered into a separate participation agreement with the Organizer.
“Visitor”, a natural person who registers through the Website in order to visit the Fair.
“User”, any natural person who visits the Website or registers through the Website.
“Admission Badge”, the personalized fair admission badge bearing a barcode or QR code and generated upon Visitor registration.
“KVKK”, the Turkish Personal Data Protection Law No. 6698.
“Privacy Notice”, the Texhibition Istanbul Website and Visitor Registration Privacy Notice.
2. SCOPE, PARTIES AND ACCEPTANCE
These Terms of Use govern the use relationship between the Organizer and Users who benefit from the Website and the free Visitor registration, Admission Badge creation and event information services offered through the Website.
For Exhibitors, these Terms apply solely to the use of the Website. Matters concerning the allocation of stands to Exhibitors, payment, installation, cancellation and liability are governed by the separate Participation Agreement and Fair Participation Rules. In the event of any conflict between these Terms and the Participation Agreement, the Participation Agreement shall prevail.
When submitting the Visitor registration form, the User declares, by ticking a separate box, that they have read the version of these Terms then in force. The Organizer records the time and method of acceptance for evidentiary purposes. This record is retained to demonstrate that the User was given the opportunity to become acquainted with the contents of the text within the meaning of Articles 20 to 25 of the Turkish Code of Obligations No. 6098 concerning standard terms and conditions.
Your use of the Website or completion of a Visitor registration does not, in itself, mean that you have consented to the processing of your personal data on the basis of explicit consent or to receiving commercial electronic communications. Explicit consent is obtained through a separate, independent and optional declaration of intent, distinct from acceptance of these Terms.
3. INFORMATION IDENTIFYING THE SERVICE PROVIDER
Pursuant to the Law No. 6563 on the Regulation of Electronic Commerce and the Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed by Means of Such Publications:

4. LEGAL FRAMEWORK OF THE FAIR AND COMPLAINT AUTHORITY
The Fair is organized by the Organizer, which holds the relevant authorization certificate, and is included in the Fair Calendar maintained by the Union of Chambers and Commodity Exchanges of Türkiye (TOBB), within the framework of the Law No. 5174 on the Union of Chambers and Commodity Exchanges of Türkiye and Chambers and Commodity Exchanges and the Procedures and Principles for Organizing Fairs in Türkiye.
THIS FAIR IS ORGANIZED UNDER THE SUPERVISION OF TOBB (THE UNION OF CHAMBERS AND COMMODITY EXCHANGES OF TÜRKİYE) PURSUANT TO LAW NO. 5174.
Organizer’s authorization certificate number: Y-624. Fair Calendar registration information: March / September.
Users may submit their complaints concerning the Fair to the Organizer or directly to TOBB. TOBB’s contact details are displayed prominently at the Fair venue and published on the Website.
5. VISITOR REGISTRATION AND ADMISSION BADGE
A free Visitor registration completed through the Website indicates that the application has been received and that a personalized Admission Badge may be issued. Completion of the registration does not mean that the right to enter the Fair venue has been acquired unconditionally.
Admission to the Fair venue is subject to applicable legislation, organizational and security rules, the capacity of the Fair venue, the rules of the venue operator and the decisions of competent authorities.
Where necessary for security, public order, compliance with legislation or the proper conduct of the organization, the Organizer may verify registration details, request additional information, cancel false or duplicate registrations and restrict admission to the Fair venue where justified grounds exist. For the purposes of this clause, justified grounds include in particular:
- providing false information in the registration form;
- transferring or reproducing the Admission Badge;
- breaching the security rules of the Fair venue;
- a restrictive admission decision issued by a competent authority;
- the Fair venue reaching full capacity.
If admission is restricted, the Organizer shall, upon request, notify the User in writing of the reasons for the restriction.
The Admission Badge is personal to its holder and may not be transferred, reproduced or used by another person. The Organizer must be notified without delay if the badge is lost, misused or shared with unauthorized persons.
6. SCANNING OF THE ADMISSION BADGE AND DATA SHARING WITH EXHIBITORS
At the Fair venue, Exhibitors may wish to scan the barcode or QR code on the Visitor’s Admission Badge at their stands. This may take place only where the Visitor physically presents the badge for scanning.
The transfer of the Visitor’s registration details to the relevant Exhibitor as a result of scanning the Admission Badge is subject to the Visitor’s explicit consent. Consent is obtained separately during registration or when the badge is scanned for the first time and may be withdrawn by the Visitor at any time.
Once the transfer takes place, the relevant Exhibitor becomes an independent data controller in respect of the transferred personal data for the purposes determined by that Exhibitor. The Exhibitor is responsible for the processing of such data. Under the Participation Agreement, the Organizer informs Exhibitors of this obligation and requires them to undertake compliance with it.

7. FAIR VENUE RULES AND IMAGE RECORDING
A closed-circuit television system may be operated at the Fair venue for security purposes. Areas subject to camera recording are identified by on-site information signs in accordance with Article 10 of the KVKK.
The Organizer may take photographs and make video recordings at the Fair venue for the promotion of the Fair. Other than general-view footage, recordings in which an individual can be identified and which will be used for promotional purposes are subject to explicit consent. A Visitor may state during registration or notify the information desk at the Fair venue that they wish to remain outside the scope of such recordings; the Organizer shall honor this request.
8. AGE RESTRICTION
The Fair is a trade event intended for industry professionals. Admission to the Fair venue and Visitor registration through the Website are limited to persons who are at least eighteen years of age. The Organizer may establish a separate procedure for exceptional circumstances, such as accompanied admission or student visits, and announce such procedure separately.
9. VISA INVITATION LETTER REQUESTS
Visitors attending from abroad may request an invitation letter for use in a visa application. Fulfilling such a request requires the processing of passport information and is carried out only upon the application of the requesting person.
Issuance of an invitation letter does not mean that a visa will be granted and does not make the Organizer responsible for the outcome of the visa application. Information on the personal data processed in this context is provided in the Privacy Notice.
10. USER OBLIGATIONS
The User undertakes to:
- provide accurate, current and personal information in the registration form and update such information if it changes;
- where it is necessary to share another person’s personal data, have the requisite legal authority to do so and inform the data subject pursuant to Article 10 of the KVKK;
- use the Website and Admission Badge in accordance with the law, the principles of good faith, event rules and their intended purpose;
- comply with the security and occupational health rules applicable at the Fair venue and the instructions of the venue operator.
11. PROHIBITED USES
In particular, the User shall refrain from:
- engaging in automated queries, malware activities, unauthorized access or reverse engineering that may compromise the security or operation of the Website;
- collecting Website content or Visitor or Exhibitor lists using automated tools (data scraping). Such conduct may also infringe the rights of the database producer under Additional Article 8 of the Law No. 5846 on Intellectual and Artistic Works;
- transmitting content that is unlawful, misleading, infringes rights or is harmful;
- carrying out commercial activities, distribution or promotion at the Fair venue without the Organizer’s written permission.
In the event of a breach of these obligations, the Organizer may, in a manner proportionate to the nature of the breach, restrict access, suspend or cancel the registration and exercise any other rights available under applicable legislation. The severity and repetition of the breach and the risk arising from it shall be taken into account when assessing proportionality.
12. COMMERCIAL ELECTRONIC COMMUNICATIONS
Commercial electronic communications are sent within the framework of Law No. 6563 and the Regulation on Commercial Communications and Commercial Electronic Messages.
Where the recipient is a merchant or tradesperson, commercial electronic communications may be sent without prior consent. Even in this case, the recipient retains the right to opt out, and records of consent and refusal are transferred to the Commercial Electronic Message Management System (İYS).
Where the recipient is not a merchant or tradesperson, commercial electronic communications are sent on the basis of prior consent.
The right to opt out may be exercised through the easy and free electronic method indicated in each communication or through İYS. Communications shall cease no later than three business days after receipt of the opt-out request.
For the processing of personal data for marketing purposes, the requirement for a lawful basis under the KVKK must also be satisfied separately; the exception under Law No. 6563 does not, by itself, constitute a sufficient lawful basis for processing under the KVKK.
13. CHANGES TO THE FAIR PROGRAM, POSTPONEMENT, CANCELLATION AND FORCE MAJEURE
The date, time, hall, program, speakers, event content or access conditions of the Fair may be changed due to organizational requirements, force majeure, decisions of public authorities, security considerations or similar justified reasons.
Force majeure means events beyond the parties’ control that could not have been foreseen or avoided. Natural disasters, epidemics, war, acts of terrorism, general strikes, cyberattacks, widespread disruption of energy or communications infrastructure and prohibitive decisions of competent authorities are included within this scope. Articles 136 to 138 of the Turkish Code of Obligations concerning impossibility of performance and hardship shall apply to the consequences of force majeure.
Updated information will be announced through the Website and via the communication channels provided during registration. Rights arising under mandatory provisions of applicable legislation are reserved.
14. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The intellectual and industrial property rights in the trademarks, logos, designs, text, images, videos, software, databases and other content relating to the Website belong to the Organizer, the Istanbul Textile and Raw Materials Exporters’ Association (İTHİB) or the relevant rights holders.
Content may be viewed solely for personal, non-commercial information purposes. Copying, modifying, publishing or commercially exploiting the content, or making it available to third parties, without the rights holder’s prior written permission is prohibited.
The limitations under Article 38 of Law No. 5846 concerning personal use and Article 35 concerning quotations, as well as the exceptions to the scope of trademark rights under the Industrial Property Law No. 6769, are reserved.
15. USER CONTENT AND SOCIAL MEDIA
Ownership of rights in content shared by the User on the Website or on social media using official hashtags relating to the Fair remains with the User.
If the User wishes such content to be used for the promotion of the Fair, the scope and duration of use shall be agreed separately and explicitly. The Organizer shall not use User content in promotional materials without explicit permission.
16. THIRD-PARTY LINKS AND SERVICE PROVIDERS
The Website may contain links to third-party websites or to verification, mapping, payment, social media and similar services. Activities carried out by third parties within their own domains are subject to their own terms and policies.
This provision does not relieve the Organizer of its statutory obligations in respect of service providers that act under its selection and instructions and qualify as data processors within the meaning of Article 3 of the KVKK. The Organizer enters into written agreements with data processors within the scope of Article 12 of the KVKK.
17. SERVICE CONTINUITY AND LIABILITY
The Organizer takes reasonable technical and administrative measures to ensure the secure and orderly operation of the Website. Temporary interruptions may occur due to maintenance, updates, connectivity issues or problems with third-party infrastructure. The Organizer does not warrant uninterrupted access to the Website.
The Organizer’s liability arising from intent or gross negligence, as well as its obligations under mandatory provisions of applicable legislation, may not be limited or excluded in any way. This follows from the mandatory nature of Article 115 of the Turkish Code of Obligations.
In cases of slight negligence, the Organizer’s liability is limited to losses that are foreseeable and typical in view of the nature of the contract. The User is responsible for consequences arising from the User’s own fault, device or connection, the acts of a third party or use contrary to these Terms.
With respect to losses that may occur at the Fair venue, the provisions of third-party liability insurance obtained in accordance with fair legislation and the rules concerning the liability of the venue operator are reserved.
18. PROTECTION OF PERSONAL DATA
Information concerning the processing of personal data is provided in the Privacy Notice, while information concerning cookies and similar technologies is provided in the Cookie Policy. These texts constitute integral annexes to these Terms and remain in force independently of these Terms.
19. UPDATES TO THE TERMS AND VERSION MANAGEMENT
These Terms may be updated in line with changes to applicable legislation or the scope of the services.
Material changes will be announced through the Website before taking effect and communicated to registered Users through the contact channel provided. A material change means an amendment that increases the User’s obligations, restricts the User’s rights or significantly changes the scope of the service.
Each version is published with a version number and effective date. Previous versions are kept accessible as an archive on the Website.
Updates shall not apply retroactively. Mandatory provisions of applicable legislation remain reserved with respect to pre-existing relationships.
20. NOTICES AND FORMAL NOTIFICATIONS
The Organizer may send notices to the User’s email address provided during registration or publish them through the Website. The User is responsible for keeping this address up to date.
Official service and notification procedures under the Notification Law No. 7201 and related legislation are reserved.
21. ASSIGNMENT, SEVERABILITY AND WAIVER
The Organizer may assign its rights and obligations relating to the organization of the Fair to its group companies or successor, provided that the User’s rights are not reduced.
If any provision of these Terms is held to be invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be deemed replaced by a valid provision that most closely reflects the parties’ intended purpose.
The Organizer’s failure to exercise any right arising from these Terms does not constitute a waiver of that right.
22. GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION
These Terms are governed by Turkish law.
Where the User qualifies as a merchant within the meaning of the Turkish Commercial Code No. 6102, the Istanbul Bakırköy Courts and Enforcement Offices shall have jurisdiction over the resolution of disputes. Pursuant to Article 17 of the Code of Civil Procedure No. 6100, this jurisdiction clause is valid only in respect of merchants and public legal entities.
Where the User does not qualify as a merchant, the general rules on jurisdiction shall apply. For disputes falling within the scope of the Consumer Protection Law No. 6502, the mandatory provisions concerning the duties and jurisdiction of consumer arbitration committees and consumer courts are reserved.
23. LANGUAGE AND CONTACT
If these Terms are published in different languages and there is any discrepancy between the texts, the Turkish text shall prevail, without prejudice to mandatory provisions of applicable legislation.
